Welcome to Lendixio. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

We reserve the right to modify these Terms at any time. Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms.

2. Description of Services

Lendixio provides a lender matching platform that connects real estate investors with potential lenders. Our services include:

• Collecting and analyzing your loan and property information
• Matching you with lenders in our network based on your specific needs
• Facilitating communication between borrowers and lenders

Important: Lendixio is NOT a lender. We do not make loans, guarantee loan approvals, or determine loan terms. We are a matching service only.

3. User Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our services. By using our services, you represent and warrant that you meet these eligibility requirements.

4. User Obligations and Conduct

When using our services, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of any account credentials
• Notify us immediately of any unauthorized use of your account
• Comply with all applicable federal, state, and local laws
• Not use our services for any fraudulent or unlawful purpose
• Not interfere with or disrupt the operation of our services
• Not attempt to gain unauthorized access to our systems

5. No Guarantee of Loan Approval

Lendixio does not guarantee that you will be matched with a lender or that any lender will approve your loan application. All lending decisions are made solely by the individual lenders, and are subject to their own underwriting criteria, terms, and conditions.

We make no representations or warranties regarding the rates, terms, or availability of loans from any lender in our network.

6. Lender Relationships

When matched with a lender, you will enter into a direct relationship with that lender. Lendixio is not a party to any agreements between you and any lender. Each lender operates independently and is responsible for:

• Their own lending decisions and underwriting standards
• All loan terms, rates, and fees
• Compliance with applicable lending laws and regulations
• Customer service and loan servicing

7. Fees

Lendixio's matching service is currently free for borrowers. We may receive compensation from lenders in our network. Any fees charged by lenders are separate and are governed by your agreement with that lender.

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Lendixio or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services or content without our express written permission.

9. Disclaimers of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Any warranty that our services will be uninterrupted, timely, secure, or error-free
• Any warranty regarding the quality, accuracy, or reliability of lender matches

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENDIXIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This includes but is not limited to damages arising from your use or inability to use our services, any dealings with lenders, or any unauthorized access to your information.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lendixio and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of our services or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use our services will immediately cease.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lendixio regarding our services and supersede all prior agreements and understandings.
